1. GENERAL PROVISIONS
1.1. This proposal, pursuant to Article 395 of the Civil Code of the Republic of Kazakhstan, is a public offer (hereinafter — the Offer). Full and unconditional acceptance (agreement) of the terms of this Offer, in accordance with Article 396 of the Civil Code of the Republic of Kazakhstan, is deemed to occur when the Buyer performs conclusive actions — placing an order, paying for and/or receiving a Ticket through the Service, which confirms acceptance of the Offer on the terms set forth below.
1.2. Limited Liability Partnership "Livetickets KZ" (hereinafter — the Operator), located at: Republic of Kazakhstan, city of Almaty, Medeu District, Dostyk Avenue, building 107, apt. 24, postal code 050051, acting as a ticket operator, offers any Internet user (hereinafter — the Buyer) to use the "Livetickets" service available at https://www.livetickets.kz/ (hereinafter — the Service) for the purchase of Tickets to cultural and entertainment events organized by the Operator’s partners — the Organizers.
1.3. The Service provides the Buyer with access to information about cultural and entertainment events, including information on venues and times, texts, illustrations, photographs, graphics, audio and video materials, and other information about cultural and entertainment events (hereinafter — the Materials), as well as ticket prices for attending events provided by the Organizers.
1.4. Information about Ticket prices posted on the Operator’s Website prior to their purchase does not constitute an offer; the actual price is subject to confirmation according to the rates available on the date of the actual Ticket purchase on the Operator’s Website.
1.5. The terms of this Offer may be amended by the Operator unilaterally by posting a new version on the Website. The new version of the Offer enters into force from the moment of its publication and applies exclusively to legal relationships arising after its posting date, unless otherwise provided by the new version itself. For orders paid before that date, the terms of the Offer that were in effect at the time of acceptance (order placement) apply.
1.6. If the Buyer disagrees with the amendments made to this Offer pursuant to clause 1.5, the Buyer may discontinue using the Service and purchasing Tickets via the Service. Continued use of the Service after a new version of the Offer has been posted on the Operator’s Website constitutes the Buyer’s full consent (acceptance) to its terms in accordance with Article 396 of the Civil Code of the Republic of Kazakhstan.
2. TERMS AND DEFINITIONS
System — an automated electronic ticketing system comprising a specialized hardware‑software complex designed to operate the System’s information resources, sell Tickets for Events, and maintain databases of sold Tickets, including the internet portal www.livetickets.kz, mobile applications for iOS and Android, embedded widgets on partner web portals, and ticket‑sales automation installed at automated box offices.
Website — the Operator’s internet portal www.livetickets.kz, as well as other online resources, including but not limited to partner websites and mobile applications that host the Operator’s System.
Automated box offices — automated box offices of the Operator and the Operator’s counterparties connected to the System.
Event — a public entertainment event held at venues designated for that purpose, including but not limited to: theatrical performances, cinema screenings, circus shows, concerts in halls, clubs or open venues, sporting competitions, and any other event admission to which is granted upon presentation of a Ticket.
Organizer — a legal entity or individual entrepreneur that organizes an Event and has contractual relations with the Operator under which it is authorized to create and sell Tickets for its Events using the System.
Venue — an organization that hosts an Event on its premises and for which Tickets are sold to Buyers through the Operator’s System.
Ticket — an accounting document issued to the Buyer via the System that certifies the contract between the Organizer and the Buyer and grants its holder the right to attend the Event.
Buyer — the natural person in whose name an order to purchase a Ticket is made.
Ticket Holder — the natural person presenting the Ticket at the Event; may differ from the Buyer.
Ticket Code — a unique numeric or alphanumeric code (including a QR code) sent to the Buyer upon Ticket purchase, which must be presented to the Organizer for admission to the Event.
Service Fee — monetary compensation charged by the Operator for its services when a Ticket is purchased through the System. The amount of the Service Fee for each Ticket is determined individually by the Operator. The Service Fee is displayed on the order page when the order is formed and until payment is made.
Personal Account (PA) — a user’s personal page in the Operator’s bonus program on www.livetickets.kz or in the mobile application. In the PA the program participant can view order/purchase history and the bonus balance. Terms of the Operator’s bonus program are posted on the Website.
3. SUBJECT OF THE AGREEMENT
3.1. Under this Offer, the Operator provides the Buyer with information‑technology services, enabling the search, selection, reservation and purchase of Tickets for Events organized by third parties (Organizers) through the automated Livetickets System.
3.2. The Operator is not the Organizer of Events and shall not be liable for their conduct, program changes, cancellation, postponement or other actions of the Organizers; the Operator acts solely as an information agent for receiving payments under agreements concluded with the respective Organizers.
4. TERMS OF PURCHASING TICKETS USING THE SYSTEM
4.1. By using the System, the Buyer accepts the terms of the Offer on the terms, in the manner and to the extent set forth herein.
4.2. When purchasing Tickets, the Buyer confirms that: (i) they have fully read the provisions of this Offer; (ii) they understand and accept the terms of the Offer; and (iii) they understand the meaning and consequences of their actions when accepting the Offer.
4.3. When the Buyer purchases a Ticket, they enter into a direct contractual relationship with the Operator. At the same time, obligations related to the organization and conduct of Events, the right to attend which is confirmed by the Ticket, arise with the Organizer.
4.4. The essential terms of the agreement concluded between the Buyer and the Operator (name of the Event, venue, date and time of the Event, seat in the hall, price of the Ticket set by the Organizer/Seller) are determined by the Buyer when purchasing the Ticket in the System and are specified in the Ticket. The Ticket also indicates its identifier (number, numeric code, barcode, QR code, alphanumeric code, etc.) required for admission to the Event.
4.5. A Ticket is considered purchased by the Buyer after payment and receipt of a notification in the form of an electronic Ticket with a code to the email address and/or by SMS to the phone number provided by the Buyer at the time of purchase.
4.6. If the Buyer does not receive the Ticket within 3 (three) hours from the time of purchase, they must contact the Operator’s customer support to clarify the order status. If customer support cannot confirm an active order for the Buyer while funds have been paid and documentary evidence exists, the Buyer will be promptly refunded the amount paid or offered an alternative purchase option, or the Operator may propose an alternative method of fulfilling its obligation, which may include provision of an alternative Ticket or a Ticket of a different price category (either higher or lower). If the Buyer raises no objections, such alternative shall be deemed proper performance of the Operator’s obligations under the Offer.
4.7. The Operator confirms that it is authorized by Organizers to accept from Buyers the funds received as payment for Tickets and the Service Fee. All rights and obligations arising from the Buyer’s purchase of a Ticket for an Event arise directly with the Organizer. The Operator is not a payment institution or payment agent. The Operator is an information‑technology service provider for its clients and partners.
4.8. The Buyer consents that the personal information provided to the Operator when placing Ticket orders and/or during subsequent or prior communications with the Operator’s staff may be transferred to third parties, including by cross‑border transfer, for the purposes of storage and/or processing with whom the Operator has contractual relationships exclusively for storage and processing purposes. The Operator warrants that agreements with such third parties include necessary provisions to ensure confidentiality and non‑disclosure of such data. The Buyer agrees that the Operator may store the information provided at purchase, payment and/or receipt of the Ticket for no less than three years from the date of performance of the relevant Agreement by the Operator. The provisions of this paragraph do not apply to Organizers whose Event Tickets are sold through the Operator’s System.
4.9. By purchasing and/or receiving Tickets using the Operator’s System, the Buyer consents to receiving from the Operator (i) electronic mails that the Operator may send after purchase, including in the event of Event cancellation, and (ii) messages, including voice messages (SMS, WhatsApp and other messengers), to the phone number/messenger provided by the Buyer.
4.10. The Buyer hereby confirms that the personal data provided when purchasing Tickets in the Operator’s System are true, accurate and ensure the Operator’s ability to contact the Buyer if circumstances arise that require notification.
4.11. A Ticket shall not be delivered to the Buyer before full payment. Payment for Tickets purchased using the System may be made by any lawful means permitted in the Republic of Kazakhstan, including but not limited to: cash, non‑cash payment, QIWI terminals, mobile phone balance, card payment, or in the form of bonuses according to resources offered by the Operator. A Ticket must be paid within the time specially allotted for the specific Event. If the Ticket is not paid within the specified period, the reservation shall be cancelled and the Ticket shall be re‑released for sale.
4.12. Payment authorization and the processing of personal data provided by the Buyer in connection with payment are carried out by the issuing bank or the relevant payment system. The issuing bank or payment system may refuse payment authorization for reasons provided by law, bank rules or international payment system rules, including suspicion of fraudulent activity.
4.13. The moment of payment is deemed to be the receipt of funds to the Operator’s settlement account or receipt of confirmation of successful payment from the payment organization. Until such moment, the Operator is not obliged to reserve the Ticket for the Buyer and bears no obligation to deliver the Ticket.
4.14. All issues related to payment processing, authorization and processing of personal data in the payment process must be resolved by the Buyer directly with the issuing bank or payment system.
4.16. The Operator is not liable for delays or impossibility of payment caused by actions (or inaction) of banks, payment systems, telecom operators and other third parties, nor for incorrect payment details provided by the Buyer. All risks associated with non‑execution of payment for such reasons are borne by the Buyer.
5. RIGHTS AND OBLIGATIONS OF THE OPERATOR
5.1. The Operator undertakes to:
5.1.1. Carry out the sale and processing of Ticket orders for Events in accordance with Buyers’ requests placed when purchasing a Ticket in the System, using best efforts.
5.1.2. Provide Buyer consultation on Ticket sales for Events by phone, in chats, social networks, messengers and/or via email.
5.1.3. Provide services to the Buyer properly and with quality meeting the requirements of this Offer.
5.1.4. Provide the Buyer with complete, accurate and comprehensive information about Events by posting such information on the Operator’s Website.
5.1.5. Timely notify Buyers of Event cancellations/postponements using one or more available communication channels. If the Operator has fulfilled all notification requirements but, for any reason, the Buyer did not receive/see the notification, changed their phone number, or does not use messengers, email or social networks, the Buyer bears full responsibility for non‑attendance of the Event.
5.1.6. Not transfer the Buyer’s personal data to third parties except as provided in clause 4.7 of this Offer and as required by the laws of the Republic of Kazakhstan. Disclosure of such information to the Operator’s employees and other persons engaged to perform obligations to the Buyer under clause 4.7 does not constitute a breach. Disclosure to state authorities in accordance with legal requirements is not a breach.
5.2. The Operator has the right to:
5.2.1. Require the Buyer to comply with and perform the terms of this Offer.
5.2.2. Refuse to provide services, notifying the Buyer, without giving reasons.
5.2.3. Cancel an Order for a Ticket if it is not paid by the Buyer within the time allotted for payment for the specific Event.
5.2.4. Charge a Service Fee for use of the online Ticket purchase service, provided the amount of such Service Fee is clearly indicated. Unless otherwise provided by Event Organizers, the Service Fee is set by the Operator for cinema screenings and other Events.
5.2.5. Send informational and promotional emails and SMS messages to the Buyer’s email address, messengers and mobile phone.
5.2.6. Set a limit on the number of Tickets sold to one Buyer in a single order through the System. The Operator may, at its discretion, set a limit on the number of Tickets available for purchase by a Buyer for specified contact details (email address and phone number) for an Event. The exact limit is indicated by the Operator on the specific Event page on the Website. A Buyer may purchase a quantity exceeding the limit only with the Operator’s prior written consent. In such case, the Operator may refuse the Buyer’s purchase of a quantity exceeding the limit without explanation.
5.2.7. Amend the terms of this Offer unilaterally by publishing a new version on the Website. The new version comes into force upon posting and applies only to legal relations arising after its publication date, unless otherwise provided by the new version. For orders paid before the posting date, the terms in effect at the time of acceptance (payment) apply.
5.2.8. Refrain from selling Tickets under the "Child" tariff for Events and film screenings ending later than 22:00, and for Events and films with age restrictions.
5.2.9. If, after purchase through the System, the Operator is unable to provide the Buyer with a Ticket or otherwise fulfill its obligations for technical or any other reasons (including System malfunction or high load), the Operator may offer the Buyer an alternative means of performance (including but not limited to substituting another seat for the same or another Event, providing compensation in various forms, or any combination thereof). The Operator’s (and/or Organizer’s) original obligation under the Ticket shall be deemed satisfied upon provision of another form of performance in accordance with the rules on accord and satisfaction under Article 369 of the Civil Code of the Republic of Kazakhstan.
6. RIGHTS AND OBLIGATIONS OF THE BUYER
6.1. The Buyer has the right to:
6.1.1. Receive confirmation of the Ticket purchase (including, but not limited to, SMS, email, or messenger notification).
6.1.2. Receive complete and accurate information about the Event and the conditions of attendance.
6.1.3. Exchange and/or return the Ticket and receive its monetary value where applicable.
6.1.4. In cases provided for in clause 5.2.9 of this Offer, return the purchased Ticket in the prescribed manner and receive the corresponding monetary compensation, or unconditionally and irrevocably accept/agree to an alternative method of performance by the Operator (and/or Organizer) with respect to the Ticket.
6.1.5. Use the option of installment payment for Tickets where and in the manner specified by the Operator.
6.2. The Buyer is obliged to:
6.2.1. Bear sole responsibility for the accuracy of the personal data they enter and for the safekeeping of the received Ticket Code. In case of any changes to personal data, the Buyer must update their contact information in the Operator’s Website database to ensure proper notification about Events and/or schedule changes.
6.2.2. When purchasing Tickets under "Child" or "Student" tariffs, have and present a document confirming student or school status from the relevant educational institution (school certificate or student ID) to the inspector upon entry to the Venue.
6.2.3. Independently familiarize themself with the internal rules of the Venues for which they purchase Tickets (etiquette, dress code, attendance rules, etc.).
7. TICKET RETURN TERMS
7.1. Refunds of Ticket costs are carried out in accordance with these Offer terms, the refund rules established by the respective Event Organizers, and the current legislation of the Republic of Kazakhstan, including the Civil Code of the RK and the Law of the RK "On Protection of Consumer Rights".
7.1.1. General conditions for return and exchange of Tickets are established by the Organizers of the respective Events. The Operator acts solely as an information‑technology intermediary and is not responsible for the return and exchange rules set by Organizers.
7.1.2. Conditions for return and exchange of Tickets may be set by Organizers individually for each Event. If the Organizer has not posted information on the return conditions on the Event page in the System, the Buyer may review them on the Organizer’s official website or at the Event venue (box offices, ticket zones, administrative premises of the cinema, theater or other facility).
7.2. Refunds in case of Event cancellation, postponement or replacement
7.2.1. In the event of cancellation, postponement or replacement of an Event, the Ticket price shall be refunded upon receipt of an official notice from the Organizer.
7.2.2. Funds shall be returned to the Buyer by the payment method used at the time of purchase within the period specified by the Organizer in the notice, but no later than 10 (ten) business days from the date the Operator receives such notice.
7.2.3. Refunds are made only for Tickets purchased through the Operator’s System.
7.2.4. Where Tickets were purchased by the Buyer not directly through the Operator’s System but from third parties (including intermediaries, resellers or other persons not official partners of the Operator), the Operator is not responsible for such purchases and does not process refunds for them.
7.2.5. Refunds may be made only to the person who placed the order in the Operator’s System and to the same payment details from which the payment was made, unless otherwise agreed by the parties.
7.3. Refunds at the Buyer’s initiative
7.3.1. If the Buyer refuses to attend an Event for reasons not attributable to the Operator or Organizer, a Ticket refund is possible if the conditions set forth in this section and the Organizer’s rules are met.
7.3.2. Minimum timeframes within which a refund is possible:
for cinema screenings — no less than 30 minutes before the screening start;
for theatrical events — no less than 3 hours before the start;
for concerts, tours, sporting, tourist events, master classes and other entertainment events — no less than 72 hours before the start;
for hockey club matches — in the timeframes established by the respective Organizer. 7.3.3. If the Organizer has established different return rules, the Organizer’s rules shall apply in accordance with clause 7.1.2 of the Offer.
7.4. Compensation deductions
7.4.1. When a Ticket is returned at the Buyer’s initiative, the Operator retains the Service Fee in full if such fee was charged at purchase.
7.4.2. When returning a Ticket for Events where no Service Fee was charged, the Operator may retain compensation for actual expenses related to processing the refund (including commissions of banks, acquiring systems and payment operators) amounting up to 5% (five percent) of the nominal Ticket price, but not exceeding the amount of documentarily confirmed expenses.
7.4.3. The above deductions do not apply in cases of Event cancellation or postponement at the Organizer’s initiative.
7.5. Special conditions of certain Organizers
7.5.1. Refunds for Tickets purchased for Events held under conditions established by certain Organizers are carried out in the manner set by them; such conditions are indicated on the Event page in the System.
7.5.2. Issues related to refunds for Tickets to Events of specific Organizers are handled in the manner established by the respective Organizer.
7.6. Refund procedure
7.6.1. Refunds are made to the bank card from which payment was made, or by another method agreed with the Buyer, within 10 (ten) business days after confirmation of order cancellation.
7.6.2. At the Buyer’s request, the refund amount may be credited to the Personal Account balance in the System for subsequent purchases.
7.6.3. If the Buyer requesting a refund is a participant in the Operator’s Bonus Program, the refund conditions set out in the Bonus Program Rules posted on the Operator’s Website apply.
7.6.4. For Tickets purchased using promotions, promo codes or bonus funds, refunds are processed in accordance with the rules of the applicable program.
7.7. Resolution of refund disputes
7.7.1. If questions or disputes arise regarding a Ticket refund, the Buyer may submit a claim or complaint to the Operator in the manner set out in clause 10 of this Offer.
7.7.2. The Operator shall assist the Buyer in resolving the claim, including forwarding the claim to the relevant Organizer and informing the Buyer of the progress of its consideration.
8. LIMITATION OF LIABILITY
8.1. The Operator shall not be liable for the Buyer’s failure to comply with age and other restrictions established by the Organizer or Venue, nor for consequences arising from the Buyer’s non‑compliance with the requirements of clause 4 of Article 36 of the Law of the Republic of Kazakhstan "On the Rights of the Child in the Republic of Kazakhstan."
8.2. The Operator shall not be liable for the Organizer’s failure to perform or improper performance of obligations related to the holding of an Event (including cancellation, postponement, or program changes), for the quality of services provided by the Organizer, or for damage caused to the Buyer by third parties.
8.3. The Operator shall not be liable for the Buyer’s losses resulting from: improper entry of contact or payment details by the Buyer; actions of banks, payment systems, telecom operators and other third parties; technical failures, access restrictions to the System, hacker attacks, and other circumstances beyond the Operator’s control.
8.4. The Operator’s liability is limited to refunding amounts paid by the Buyer in cases expressly provided for by this Offer and the applicable legislation of the Republic of Kazakhstan.
9. FORCE MAJEURE
9.1. The Parties are released from liability for failure to perform or for improper performance of obligations under the Agreement for the duration of force majeure events, which include: extraordinary and unforeseen events, natural disasters, wars, military actions, mass unrest, terrorist acts, epidemics, quarantine measures, acts of state authorities, strikes and other circumstances preventing performance of obligations.
9.2. The Party affected by such circumstances must notify the other Party as soon as possible of the occurrence of the force majeure and provide any available supporting documents from competent authorities.
10. PROCEDURE FOR HANDLING CLAIMS AND DISPUTES
10.1. All disagreements and disputes arising out of or in connection with this Offer shall, where possible, be resolved through negotiations between the Parties.
10.2. If no agreement is reached, the dispute shall be resolved in accordance with the applicable legislation of the Republic of Kazakhstan: disputes between legal entities and individual entrepreneurs shall be submitted to the Kazakhstan International Arbitration in Almaty; disputes with natural persons shall be heard by courts of general jurisdiction at the location of the Operator.
10.3. Buyer inquiries and complaints related to the Operator’s services and Events shall be submitted to the Operator in person, sent by registered mail with return receipt, or sent by email to [email protected].
10.4. To resolve technical issues when determining the Buyer’s fault resulting from wrongful actions in using the System, the Operator may engage competent organizations as experts. If the Buyer is found at fault, the Buyer shall reimburse the costs of the expert examination.
11. MISCELLANEOUS
11.1. The Agreement enters into force from the date the Buyer confirms acceptance of the terms of this Public Offer when directly making a Ticket purchase, thereby joining the Agreement.
11.2. The Buyer may unilaterally withdraw from the Agreement provided the Operator has no outstanding obligations under the Agreement by sending the Operator a corresponding written notice at least 30 (thirty) calendar days prior to the intended termination date. The Buyer acknowledges and agrees that non‑refundable Tickets (if explicitly indicated on the Operator’s Website) are not subject to refund.
11.3. The Operator may terminate the Agreement by publishing a corresponding notice on the Operator’s official website or by sending the Buyer a corresponding written notice or SMS message at least 30 (thirty) calendar days prior to the intended termination date to the contact details provided by the Buyer when placing the Ticket order.
11.4. In all other matters not provided for by the Agreement, the Parties shall be governed by the applicable legislation of the Republic of Kazakhstan.
